These Terms of Use ("Terms") are a binding agreement between you and ATOMIC ("we") governing your use of the Radio Atomic app and radio-atomic.com (the "Service"). By using the Service you accept these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 13 years old (or the minimum legal age in your country) to use the Service, and old enough to form a binding contract.

2. The Service

Radio Atomic lets you stream third-party live radio stations (sourced from the public Radio Browser directory) and listen to or publish podcasts. We do not own or control third-party radio streams and are not responsible for their content or availability.

3. License

We grant you a personal, non-exclusive, non-transferable, revocable license to use the Service for your own non-commercial enjoyment, subject to these Terms.

4. User-generated content (podcasts)

• You retain ownership of podcasts you upload. You grant us a worldwide, non-exclusive, royalty-free license to host, store, reproduce, stream and display your content to operate and promote the Service.
• You represent that you own or have all rights to the audio you upload and that it does not infringe any third-party rights.
• You are solely responsible for your content.

5. Acceptable use & zero tolerance

There is zero tolerance for objectionable content or abusive behavior. You must not upload, share or transmit content that is:

• illegal, hateful, harassing, defamatory or that incites violence;
• sexually explicit, pornographic, or exploitative of minors;
• extremist, terrorist, or promoting self-harm;
• fraudulent, spam, malware, or infringing intellectual property;
• otherwise objectionable.

We use AI moderation plus user reporting. We may remove content, hide it, or ban users who violate these Terms, at our discretion and without notice.

6. Reporting, blocking & takedown

Every podcast can be reported in the app. Reported content is reviewed and removed if it violates these Terms; you can also block a creator so you never see their content. Content reaching our flag threshold is hidden automatically. Copyright owners may request removal by emailing us with details of the work and the infringing episode.

7. Subscriptions & billing

• Premium is an auto-renewing subscription billed through your Apple account at the price shown in the app.
• It renews automatically unless cancelled at least 24 hours before the end of the current period.
• Manage or cancel anytime in your Apple account settings. Restore is available in the app.
• Prices may vary by region and may change with notice.

8. Disclaimers

The Service is provided "as is" without warranties of any kind. Live radio streams are operated by third parties and may be unavailable, change, or contain content we do not control.

9. Limitation of liability

To the maximum extent permitted by law, ATOMIC is not liable for indirect, incidental or consequential damages, or for third-party content or streams, arising from your use of the Service.

10. Termination

We may suspend or terminate your access for any violation of these Terms. You may stop using the Service and delete your data at any time.

11. Governing law

These Terms are governed by the laws of the United Arab Emirates, without regard to conflict-of-law rules.
